PAYMENT AGREEMENT PARTIES -This Payment Agreement (hereinafter referred to as the “Agreement”) is entered into on the date of the accompanied payment receipt, by and between Monkey On Your Back Seminars, and Payee (hereinafter referred to as the “Creditor”) (collectively referred to as the “Parties”). AGREEMENT -The Parties agree that there is not refunds granted for cancelations made less than 48 hours in advanced. oThis is for the purpose of event space rentals. -Cancelations must be in writing, submitted through the email page on the website. -Refunds will not be granted if a person or persons have to be asked to leave or escorted off of the property at any point during the seminar. -All payments are to be made in full by Debit, Credit Card, or Cash, before entry. DAMAGES -Any damages intentionally caused to property will be deducted directly from online payments, after a summary of damages are provided. OR cash will be requested and accepted in the event that online payment is not an option. -If offender refuses to settle cordially out of court, court action may be taken to recoup damages. REFUNDS -Refunds will be issued in the same manor payment was made. -Refunds will be issued if there is a cancelation of the event. GOVERNING LAW -This Agreement shall be governed by and construed in accordance with the laws of New York. SEVERABILITY -In an event where any provision of this Agreement is found to be void and unenforceable by a court of competent jurisdiction, then the remaining provisions will remain to be enforced in accordance with the Parties’ intention. DISPUTE RESOLUTION -Any dispute or difference whatsoever arising out of or in connection with this Agreement shall be submitted to Sean LeeRoy (Arbitration/mediation/negotiation) in accordance with, and subject to the laws of New York. ENTIRE AGREEMENT -This Agreement contains the entire Agreement and understanding among the Parties hereto with respect to the subject matter hereof, and supersedes all prior agreements, understandings, inducements and conditions, express or implied, oral or written, of any nature whatsoever with respect to the subject matter hereof. The express terms hereof control and supersede any course of performance and/or usage of the trade inconsistent with any of the terms hereof.
